The terms and conditions governing your use of DriverWell

Important Medical Disclaimer
DriverWell is a wellbeing support tool, not a medical service. It does not provide medical diagnoses, clinical treatment, or emergency response. If you are experiencing a medical or wellbeing emergency, please call 999 or contact the Samaritans on 116 123 immediately.
1. Agreement to Terms
By accessing or using DriverWell (driverwell.co.uk), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the platform.
DriverWell is operated by Harling Yorkshire Limited trading as DriverWell. These terms are governed by the laws of England and Wales.
2. Service Description
DriverWell provides free individual wellbeing support, a Free Dashboard for fleet operators and optional paid commercial and learning products for the transport industry. The platform provides:
- Mood tracking and check-in tools
- Stress relief and mindfulness exercises
- Fatigue management tools
- Peer support forum using account profile names
- AI-powered wellbeing chat (RoadMate)
- Emergency support resources and helpline information
- Optional private wellbeing records where the relevant consent choice is recorded
- Source-linked learning, blog articles and general wellbeing guidance
- Operator resources with aggregate reporting and evidence boundaries
Free and paid boundaries: Individual wellbeing support remains free for life. The fleet Free Dashboard is free forever. The Fleet Wellbeing Suite and selected Road Transport courses are optional paid products. DriverWell does not sell personal wellbeing data.
Payments, subscriptions and course access
Stripe processes card payments. DriverWell does not receive or store full card numbers, card security codes or card expiry dates. BACS invoicing may remain available for agreed fleet accounts.
Fleet Wellbeing Suite card subscriptions renew monthly until cancelled. The Charter Partner introductory price is fixed for the first 12 months while the subscription remains active. It is a price commitment, not a free trial or external accreditation.
A one-off Road Transport course purchase grants personal, non-transferable access through the purchasing DriverWell account while the course remains available. Course content may be reviewed or updated when official guidance changes. DriverWell course acknowledgements remain internal unless an external accreditation body formally approves the relevant activity.
Prices and the payment frequency are shown before checkout. Nothing in these terms limits rights that cannot lawfully be excluded. Refund or cancellation requests are assessed against the applicable consumer law and any agreed business contract.
3. Medical & Clinical Disclaimer
DriverWell's controlled intended purpose is general wellbeing information, private self-reflection, fixed education and non-emergency signposting. It is not a clinical service or substitute for professional healthcare.
The formal medical-device qualification review remains open. Scored, personalised and medical-fitness features identified as higher risk are unavailable or redirected pending competent review. The remaining content and tools are not intended to:
- Diagnose any medical or wellbeing condition
- Replace advice from a qualified healthcare professional
- Provide clinical treatment or therapy
- Serve as an emergency response service
Optional mood and fatigue records are private self-reflection tools and require the recorded health-data processing choice. Browser health result bands, diabetes monitoring, sleep scoring, personalised nutrition and medical-fitness verdicts remain unavailable pending review.
RoadMate AI provides general wellbeing information and signposting after a recorded health-data processing choice. Messages are stored and sent through DriverWell's AI service provider. It is not a therapist, counsellor, medical professional or monitored emergency service. On-screen emergency information may be shown, while administrator alert creation requires the separate crisis-detection choice.
Always seek the advice of your GP or a qualified wellbeing professional for any medical or wellbeing concerns.
4. User Accounts
Some features of DriverWell require you to create an account via our authentication provider. By creating an account, you agree that:
- You are at least 18 years old
- You will provide accurate information
- You are responsible for maintaining the security of your account
- You will not share your account with others
- You will notify us of any unauthorised use of your account
You can submit an authenticated erasure request through the data-rights page. DriverWell records the request for restricted review because complete deletion requires checks across database records, stored files, suppliers, legal exceptions and backup treatment. Do not treat submission as proof that all copies have already been removed.
5. Acceptable Use & Community Guidelines
When using DriverWell's community features (peer support forum, display names), you agree to:
- Treat other users with respect and empathy
- Not post content that is abusive, threatening, discriminatory, or illegal
- Not share personal identifying information about other users
- Not use the platform to promote products, services, or political campaigns
- Not attempt to access other users' accounts or data
- Not use automated tools to scrape or collect data from the platform
We reserve the right to remove content and suspend accounts that violate these guidelines.
6. Prohibited Uses
You must not use DriverWell to:
- Violate any applicable law or regulation
- Impersonate any person or entity
- Transmit viruses, malware, or other harmful code
- Attempt to gain unauthorised access to our systems
- Interfere with or disrupt the platform's operation
- Collect user data without authorisation
- Use the AI chat to generate harmful, illegal, or misleading content
7. Intellectual Property
The DriverWell name, logo, and branding are the property of Peter McKenna. The content, design, and code of the platform are protected by copyright.
Content you create on the platform (mood entries, forum posts, chat conversations) remains your data. You grant us a limited licence to store and display this content as necessary to provide the service.
Educational content, blog articles, and resource information on DriverWell are provided for personal use. You may share links to our content but may not reproduce it commercially without permission.
8. Employer & Operator Features
Employers and operators who use DriverWell's fleet management features agree that:
- They will use the tools in accordance with UK employment law and data protection regulations
- They will not use DriverWell as a clinical assessment, medical-fitness decision or substitute for competent professional advice
- They will not use driver data to discriminate against or penalise employees for wellbeing disclosures
- They are responsible for their own duty of care obligations under the Health and Safety at Work Act 1974
- Unreviewed Toolbox Talks and health-based fleet risk reports remain unavailable pending competent review
- Fleet reporting excludes individual wellbeing records and currently excludes mood, fatigue and health metrics
9. Limitation of Liability
DriverWell is provided "as is" without any warranties, express or implied. While we strive to ensure the platform is accurate, reliable, and available, we cannot guarantee:
- Uninterrupted or error-free service
- The accuracy or completeness of any content
- That the platform will meet your specific requirements
- The availability of third-party helplines or resources we link to
To the fullest extent permitted by law, DriverWell and its operator shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.
10. Changes to These Terms
We may update these Terms of Use from time to time. We will notify users of significant changes through the platform. Your continued use of DriverWell after changes are posted constitutes acceptance of the updated terms.
11. Governing Law
These Terms of Use are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
