Fatigue: What the Tachograph Does Not Measure

The tachograph is one of the most scrutinised pieces of equipment in road transport. It records driving time, rest periods, and speed with forensic precision. Operators rely on it. Enforcement officers use it as their primary tool. And drivers know that the card in the slot is always watching.

But the tachograph measures one thing: time. It does not measure how you feel when you get behind the wheel. It does not know whether you slept properly during your rest period, whether you are grieving, whether your blood sugar dropped two hours ago, or whether you have been carrying a quiet dread about something at home for the past three weeks. It records compliance. It says nothing about capacity.

This distinction matters enormously, and the transport industry has been slow to reckon with it.

What the Rules Say, and What They Miss

The EU drivers' hours regulations, as retained in UK law, set out the maximum a driver may drive and the minimum they must rest. Nine hours of driving, eleven hours of rest. A 45-minute break after four and a half hours. These figures are not arbitrary. They were developed with fatigue research in mind, and they provide a meaningful baseline.

The problem is that they are a floor, not a ceiling. They describe the legal minimum. They say nothing about whether a driver who has technically complied is actually fit to drive.

A driver who sleeps for eleven hours in a lorry cab in a noisy service area, woken twice by other vehicles, and who is managing untreated sleep apnoea, is not the same as a driver who has had eleven hours of restorative sleep in a quiet room. The tachograph records both as compliant. The body knows the difference.

The Science of Fatigue the Card Cannot See

Fatigue is not simply the absence of sleep. It is a physiological state that impairs reaction time, narrows attention, reduces the ability to anticipate hazards, and distorts judgement in ways the driver is often the last to notice. Research from Loughborough University and the Transport Research Laboratory has consistently shown that driving while fatigued produces impairments comparable to driving over the legal alcohol limit.

Several factors contribute to fatigue that no tachograph can capture.

Sleep quality, not just sleep duration. The hours recorded as rest do not account for sleep disorders. Obstructive sleep apnoea, which is significantly more prevalent among professional drivers than in the general population due to the sedentary nature of the work and associated weight gain, fragments sleep throughout the night. A driver with undiagnosed sleep apnoea may spend eleven hours in their bunk and wake more tired than when they lay down. Studies suggest that between 20 and 40 per cent of professional drivers may have some degree of sleep-disordered breathing, yet most are undiagnosed.

Cumulative sleep debt. Fatigue accumulates across days and weeks. A driver who consistently gets six hours of sleep when their body requires eight is building a debt that a single rest period cannot repay. The tachograph resets. The body does not.

Circadian disruption. The human body is governed by a circadian rhythm that regulates alertness and sleepiness across the 24-hour cycle. Driving at 3am, 4am, or 5am places a driver in the trough of their circadian cycle, the period when the body most strongly signals the need for sleep, regardless of how many hours of rest are recorded on the card. Night-shift drivers and those on rotating schedules carry a fatigue burden that the rules do not adequately account for.

Mental and emotional load. Anxiety, depression, grief, financial stress, and relationship difficulties all disrupt sleep and consume cognitive resources. A driver who is managing a mental health crisis is carrying a fatigue burden that has nothing to do with driving hours. The tachograph is blind to all of it.

Nutrition and hydration. Blood sugar instability, dehydration, and poor nutrition all impair cognitive function in ways that mimic fatigue. A driver who has skipped breakfast, eaten a high-sugar snack at a service station, and drunk three coffees is not in the same physiological state as a driver who has eaten well and is properly hydrated. Neither the card nor the operator knows the difference.

Why This Matters for Operators

The legal framework around drivers' hours creates a compliance culture that can, paradoxically, obscure the real risk. An operator who checks tachograph data and sees no infringements may feel reassured. But compliance is not the same as safety.

The Road Safety Act 2006 and the Corporate Manslaughter and Corporate Homicide Act 2007 both create liability for operators whose management decisions contribute to fatigue-related incidents. The defence that "the tachograph showed compliance" is not a complete answer. Courts and the Health and Safety Executive have consistently held that operators have a duty to take reasonable steps to manage fatigue risk, not merely to enforce hours rules.

This is the territory that the RHA's Duty of Care framework is designed to address. It asks operators to look beyond the card and consider the whole driver: their health, their mental wellbeing, their working conditions, and the culture that surrounds them.

What Good Fatigue Management Actually Looks Like

Genuine fatigue management requires a shift from compliance monitoring to wellbeing monitoring. That does not mean intrusive surveillance. It means creating the conditions in which drivers can be honest about how they feel, and in which operators can respond constructively rather than punitively.

The most effective approaches share several features. They involve regular, low-barrier check-ins that allow drivers to flag fatigue or ill-health without fear of losing shifts. They include education about sleep hygiene, the signs of sleep disorders, and the cumulative effects of fatigue, delivered in a format that works for drivers who spend most of their time in a cab rather than an office. They create a clear, non-punitive route for a driver who does not feel fit to drive to stand down without financial penalty.

They also involve screening. Sleep apnoea screening for professional drivers is not yet mandatory in the UK, though the DVLA's guidance on sleep disorders is clear that drivers have a legal obligation to report conditions that affect their fitness to drive. Operators who proactively support screening and treatment are not only reducing risk. They are demonstrating a standard of care that matters if something goes wrong.

The Tachograph Is a Tool, Not a Safeguard

None of this is an argument against tachographs. They serve an important function. The hours rules exist for good reason, and enforcement of those rules matters. But the tachograph is a compliance tool, not a safety guarantee. It records what happened. It does not prevent what is about to happen.

The gap between compliance and genuine driver wellbeing is where most fatigue-related incidents occur. Closing that gap requires operators to ask harder questions than the card can answer: How is this driver sleeping? What is going on in their life? Do they feel able to tell us if they are not fit to drive? Is our culture one where honesty is safe?

These are not soft questions. They are the questions that determine whether a driver gets home safely at the end of a shift, and whether the public sharing the road with that driver does too.
